Data Access Statement

Data Access Statement

  1. Purpose and scope
This statement applies to devices purchased from us that generate data (e.g., via sensors, status, usage statistics). As we act as a retailer, we do not have direct access to this data—the data owner is the device manufacturer.

  2. What data is generated
Depending on the device, the following data types may be generated:
    • Status data (e.g., “on/off,” error messages)
    • Usage patterns (programs, cycles)
    • Measured values (temperature, consumption)
    • Historical data (logs)

  3. Who is the “data controller”
In most cases, the manufacturer of the device is the data holder. They are responsible for collecting, storing, managing, and making the data available.

  4. Your rights under the Data Act
    • Access: you have the right to request your device data in a structured, machine-readable format (e.g., CSV, JSON), if available.
    • Transfer: you can have the data transferred to another service provider of your choice, in accordance with the Data Act.
    • Transparency: you have the right to be informed about what data is generated, how it is accessed, and what technical means are used.

  5. How to request your data
    • You can contact the manufacturer via the appropriate channel (e.g., email, app, web portal).
    • When submitting your request, please indicate: your device (type and serial number, if known), what data you would like to receive (e.g., all data, or only specific data categories), and in what format (if possible).

  6. Costs
The Data Act stipulates that access to this data must in principle be free of charge, unless there are exceptional (reasonable) administrative costs. If costs apply, the manufacturer will make this clear to you in advance.

  7. Restrictions
    • The manufacturer may refuse to provide certain data if it is technically impossible to make it available, or if disclosure would violate trade secrets — but any refusal must be properly justified.
    • In some cases, the use of data by third parties (for which you give your consent) may not lead to the development of competing products (depending on legal restrictions).

  8. Contact and complaints
    • For requests: send your request to the manufacturer via the email address or portal they have provided.
    • If you disagree with the handling of your request, you can lodge a complaint with the supervisory authority (e.g., national data protection authority).
